THESE SERVICES MAY NOT BE APPROPRIATE FOR ALL MEDICAL CONDITIONS. 1. Introduction
BeMediq and its affiliates ("BeMediq," "we," "us," or "our") operate the websites located at https://www.bemediq.com and affiliated mobile applications ("Sites"). BeMediq is powered by Bask Health Inc. Health care services are delivered by Beluga Health, P.A. and affiliated professional entities. Pharmacy services are fulfilled through the Bask Pharmacy Network.These Terms of Use describe your rights and responsibilities in accessing BeMediq’s Services, which include:Health and wellness information;Telemedicine and telehealth services;Pharmacy access and prescription fulfillment;Administrative tools for health management;Communications and coordination with licensed providers.Your use of the Sites is also subject to our Privacy Policy.
2. Availability
Services are available only in certain U.S. states. Service availability may vary by location and offering.
3. Eligibility
You must:
Be age 18 or older;
Be located in a serviceable state;
Agree to these Terms of Use.
Meeting these requirements does not guarantee service.
4. Requirements for Use
You must have:
Compatible devices,
Internet access,
Applicable software.
Charges may apply for data usage and connectivity.
5. Consent to Telehealth
By using the Services, you consent to telehealth interactions, including audio, video, text, and data transmissions. These services include store-and-forward communication, asynchronous messaging, and synchronous visits. See the full [Consent to Telehealth] document for details and risks.
6. Privacy
Your privacy is governed by:
The BeMediq Privacy Policy, and
The Notice of Privacy Practices from Beluga Health, P.A. and affiliated providers.
These are incorporated into these Terms by reference.
7. Relationship with BeMediq
BeMediq is a technology platform. Medical care is provided by licensed professionals via Beluga Health, P.A. or similar entities. BeMediq does not form a provider-patient relationship with you.All providers using our platform are licensed in the states where they practice, and are credentialed and verified prior to delivering care.
8. Communications Consent
By enrolling in SMS or email communications, you consent to receive account, service, and promotional messages. You can opt out at any time by texting "STOP" or emailing support@bemediq.com. Text and data rates may apply.Messages are not encrypted and may be intercepted. You accept this risk when consenting to digital communications.
9. Consultative Services
Remote consultations are limited by lack of physical examination. Provide complete medical history to minimize diagnostic risk.
10. Site Content
Only communications from affiliated providers should be interpreted as medical advice. General site content is not a substitute for in-person care.
11. Registration and User Accounts
Access to Services requires registration. Keep your login information secure. Notify BeMediq immediately of any unauthorized activity. You are responsible for all account activity.
12. Prohibited Use
You may not:
Violate laws;Interfere with network security;
Misuse copyrighted material;
Reverse-engineer our software;
Exploit or distribute site content.

13. Data Ownership
Information submitted through the Sites may be used by BeMediq and affiliated providers. Personal health data is subject to HIPAA.
14. Intellectual Property
BeMediq owns all rights to its content, software, and trademarks. You may not reproduce or commercialize any material from the Sites without permission.
15. Links to Third Parties
We are not responsible for content or services on external sites linked through our platform.
16. Termination
Your access to the Sites may be terminated for violation of these Terms. BeMediq may also discontinue the Services at any time.
17. Disclaimer of Warranties
Sites and Services are provided "as is." No warranties are expressed or implied.
18. Limitation of Liability
BeMediq is not liable for indirect, incidental, or consequential damages arising from your use of the Sites or Services.
19. Indemnification
You agree to indemnify BeMediq and affiliates from claims arising from misuse, fraud, or breach of these Terms.
20. Modifications
We may update or change any part of the Sites or Terms without prior notice.
21. Pharmacy Services
If you choose to use the Bask Pharmacy Network, you authorize us to share health and personal information for fulfillment. Medications may not be in child-proof packaging.
22. Payment Terms
You agree to pay all charges incurred through your use of Services. Services may be suspended for payment failure. Payment may include fees collected on behalf of affiliated providers.
23. Medicare and Medicaid
Services are not covered by federal or state health care programs. You accept full financial responsibility. You will not seek reimbursement from any public payer.
24. Testosterone Health Program
A membership-based service for eligible users with low testosterone due to secondary hypogonadism. Includes consultations, messaging, at-home phlebotomy, and lab orders. TRT is not provided.
25. Membership Management
You may cancel, pause, or delay your membership. Membership is billed monthly and fees are non-refundable.
26. Arbitration and Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising from or relating to these Terms or your use of the Sites or Services will be resolved through binding arbitration administered by the American Arbitration Association in accordance with its rules. Arbitration will be conducted in Austin, Texas, unless otherwise required by law or agreed upon by both parties.Either party may seek temporary or preliminary injunctive relief, or bring claims related to intellectual property, in any court of competent jurisdiction in Travis County, Texas.
27. Waiver, Assignment, and Injunctive Relief
Failure to enforce a provision is not a waiver. BeMediq may assign its rights. We may seek injunctive relief for violations.
